The rise of the syndicate

With International Fraud Week coming up, CMS and the Institute for Commercial Forensic Practitioners have partnered to bring you a workshop on “The rise of the syndicate: a consideration of organised crime, its impact on organisations and what organisations can do to fight back”.

In this session, our speakers will consider:

• Organised crime and its impact on organisations;
• Key risks organisations face in relation to, amongst others, business hijacking, theft of intellectual property, money laundering and cybercrime attacks;
• Key legislation aimed at tackling organised crime. In spite of the numerous risks organisations may face, there are several legal processes that may assist organisations in fighting organised crime. These include the Anti-Dissipation Order, Interdictory Relief and the Anton Pillar Order;
• Whether these processes are effective in securing evidence and/or assets as well as some common pitfalls to note when utilising these measures (such as urgency, not making a proper case, timing); and
• Issues relating to the employees acting in concert and knowing about a syndicate but not speaking up. These would include how to prevent a syndicate from planting a trojan horse in your organisation, identifying and effectively dealing with the malicious / negligent employee.
